Course Outline and Method

This course studies the latest concept of disability rights and its legal protection in/after the Covid-19 Pandemic. It will address the challenges confronted by persons with disabilities in our society through lens of history (disability models, timeline of social movements), law (including CRPD and domestic laws on legal capacity and access to justice) and community empowerment (such as accessibility and reasonable accommodation, independent living, social security, education and employment). A human rights model derived from the Convention on the Rights of Persons with Disabilities (CRPD) and its precedent treaties will be introduced to discuss the substantive equality for persons with disabilities. Cases and local practice from Japan, China and other countries will be used to explore how to identify the vulnerability, recognized the inherent dignity and strength, and build the resilience of persons with disabilities in and after the pandemic.

The course classes mix the method of lecture and participatory discussion. It will use multiple resources such as documentary videos, inclusive arts and news stories to illustrate the disability rights issues.

Student Attainment Objectives

The course aims enlighten students on the latest idea on disability and equality through the human rights model established by the Convention on the Rights of Persons with Disabilities (CRPD) and explore the practice frontier among typical countries and communities. In particular, it will help students to:
1) Understand the new conception of disability rights and substantive equality;
2) Learn the international and domestic legal framework to ensure the equal participation of persons with disabilities in all aspects of their daily life;
3) Improve the strategies to advocate for the equal rights of vulnerable groups in and after the crisis of Covid-19 pandemic

Recommendations for Private Study

1) Students are encouraged to do the readings before each class and explore the disability experience in real world through the recommended methods, reference books and webpages;
2) Students are encouraged to bring personal feelings and observation to the class discussion;
3) Students are encouraged to explore the intersectional issues of disability and their own academic background such as nature science, computer science, literature, arts, geography, sociology, social work, and many other disciplines;
4) Students are welcome to document and share their comments through vlogs and other social media forum on disability issues in the society.

Advice to Students on Study and Research Methods

1) put the abstract concept of the Convention and laws into daily life of persons with disabilities;
2) try to follow and observe the efforts of a local origination of persons with disabilities (OPD);
3) try to observe a court hearing that involves defendants, plaintiff, witness, jurors, judges, lawyers or other participants with disabilities;
4) try to observe a public discussion including congress debate and other campaign on street of media that involves disability policy such as health care, education or employment;
5) note that all the rights of persons with disabilities are interlinked and indispensable for them to be a “whole person” in the society.
