Course Outline and Method

民法、刑法の基本的論点に関する事例問題を素材に、論点抽出、規範分析、規範定立、事例へのあてはめを行う。授業方法としては、受講生に事前に答案を提出してもらい、授業内で受講生と質疑をしながら解説を加える。答案の提出方法は、授業開始前または初回の授業で指示する。

具体的問題の中から、論点を発見抽出し、それに対応する規範の定立と事実のあてはめを通じて、具体的な答案作成の方法を習得することを目標とする。

民法分野に関する問題演習　担当　木村和成

財産法（民法１条～７２４条）の総合問題を検討します。なお、扱うテーマ、問題については事前に指定をします。

第8回～第14回　

刑法分野に関する問題演習　担当　大下英希

共同正犯の成立範囲について、様々な問題形式の中で検討します。最初の数回は基本的な論点を検討しながら、その後の参加者の理解に従って、論点を深めていく予定です。

対面授業にて実施する。

全員が課題について検討し、事前に答案を提出すること。授業では皆さんの答案を基礎に解説を行う。
