Course Outline and Method

専門ドイツ語Ⅲ（Ｊ）では、法律学の専門的内容を学ぶために、Moritz Vormbaum (Hrsg.), Spaetverfolgung von NS-UNrecht, 2023.（モーリツ・フォルンバウム編『後手に回ったナチの不法の訴追』2023年）の中から読みやすい論文を選んで検討します。法学部生からは、法律の解釈学と法哲学・法思想の間にどのような関係があるのか分かりにくいという意見を聞くことがあります。第二次世界大戦時のナチの犯罪の追及をテーマにした研究であれば、分かりやすく学べます。それを読みながら、刑法の歴史と刑法解釈について考えたいと思います。

受講生は、専門ドイツ語Ⅲ（Ｊ）を受講して、法哲学と法思想に関する歴史とその内容を深く知ります。

ロットロイトナーの論文は日本ではあまり知られていないため、日本語訳はありません。まずは自分で読んでみましよう。
