Course Outline and Method

本授業では、国際取引の現状や特徴から、国際取引法の課題を明らかにし、適用される法として国際私法、統一私法、国際的統一規則、公的規制法規とその相互関係を考察する。国際的物品売買及びそこから派生する諸問題では国際物品運送、国際貨物保険、国際的代金決済、製造物責任などについて、国内法、国際条約、諸国の法の比較法的視点も入れて考える。また、国際技術移転、国際代理店契約、プラント輸出、国際投資の法的枠組みの現状を概観する。さらに、国際取引紛争の解決手段としての国際訴訟、国際商事仲裁などに触れる。投資紛争にも言及する。

国際取引に関連する法それぞれの役割、機能を理解し、他者に説明することができる。
国際取引に関する問題について、法的な思考、文書作成ができるようになる。
